This report details significant state workers’ compensation law and rule changes in 2022. While there were 13 states that reported no legislative or administrative activity, there were 38 state legislatures that enacted workers compensation laws and 14 states that reported administrative rule changes in 2022. Medical exams, costs and fee schedules, employer rates, claim appeal and adjudication, employee versus independent contractor relating to the digital economy as well as drug testing and opioid formulary are the primary areas of law and rule activity.

This Bulletin reports on state workers’ compensation benefit payments and trends from 2013 to 2022. The Bulletin provides new data for 2022, and certain revised data for 2018 to 2021. Readers should also know that the National Academy of Social Insurance (NASI), which provides source data for the Bulletin, is no longer providing revised data on a state by state basis for private insurers, self-insurers, state funds, or medical benefits. This data is therefore not available for the revised years 2018 to 2021. Revised data for these years is available for covered workers, covered payroll, and total benefits.
